일본·한국 정부와 국제사회를 향한 요구 담아

국회의원 62명은 오는 8월 14일 일본군‘위안부' 피해자 기림의 날을 맞아 ‘8.14 일본군위안부 피해자 기림의 날 대한민국 국회의원 성명서’를 발표했다.

성명서를 주도한 윤미향 무소속 국회의원은 연명에 참여한 의원들은 현재 한·일 간에 이루어지고 있는 논의가 ‘2015 한일합의’로의 회귀나 복원이 아니라, 국제인권 원칙과 규범에 따라 피해자들의 인권과 명예가 회복되는 모색이길 바라며, 이를 위해 입법 조치를 포함한 모든 노력을 다할 것이라고 뜻을 모은 것이라고 밝혔다.

의원들은 일본 정부에 일본군‘위안부’ 문제는 일본군에 의해 조직적으로 자행된 성노예 범죄이자 인도에 반하는 범죄였음을 인정하고, 피해자들의 요구대로 공식 사죄와 법적 배상, 책임자 처벌과 역사교과서 기록 등의 책임을 질 것을 촉구했다.

윤 의원은 성명서 연명에 참여한 의원들이 세계 각국 의회와 정부에도 그동안 국제사회가 권고한 대로 일본군‘위안부’ 문제의 진실, 정의, 배상, 재발 방지 조치를 일본정부가 성실히 이행하도록 함께 노력해 줄 것을 요청했다고 설명했다.

윤미향 의원은 최근 외교부의 움직임에 대해 “윤석열 정부는 일본과의 관계 개선에만 눈이 멀어 2015 한일합의와 같은 굴욕적인 졸속 합의의 전철을 밟지 말아야 한다”면서 “피해자들이 한 분이라도 더 살아계실 때 일본 정부의 공식 사죄와 배상 등 올바르고 정의롭게 문제해결이 이루어질 수 있도록 대한민국 국회의원의 책임을 다하겠다”고 밝혔다.

한편 국회는 2017년 ‘일제하 일본군‘위안부’ 피해자에 대한 보호 지원 및 기념사업 등에 관한 법률’을 개정해, 1991년 김학순 할머니가 일본군 ‘위안부’ 피해자임을 처음으로 공개 증언한 8월 14일을 ‘일본군‘위안부’ 피해자 기림의 날’로 지정하고, 2018년부터 공식 국가기념일로 지켜왔다.

일본군‘위안부’피해자 기림의 날을 맞이하며

일본군‘위안부’ 문제의 정의로운 해결을 요구한다.

2022년 8월 14일은 우리나라가 일제 식민지로부터 해방된 지 77주년을 하루 앞둔 날이자, 김학순 할머니가 기자회견을 통해 일본군 ‘위안부’ 피해자임을 처음으로 공개 증언한 날로부터 31주년이 되는 날이다.

1991년 8월 14일, 김학순 할머니는 해방 후 반세기 동안의 강요된 침묵을 깨트리고 자신이 일본군‘위안부’ 피해자임을 공개적으로 밝혔다. 그 용기가 또 다른 용기를 만들어내어 전국으로, 또한 북한, 일본, 필리핀, 대만, 중국, 인도네시아, 네덜란드, 호주 등 세계 각지의 피해자들에게 확산되었고, 세계의 피해자들과 시민들이 함께 연대하며 일본군‘위안부’문제 해결 및 전시 성폭력 문제 해결을 위해 노력해 왔다.

2012년 대만에서 개최된 제11차 일본군‘위안부’ 문제해결을 위한 아시아연대회의 참가자들은 첫 번째 침묵을 깨트린 김학순 할머니의 용기를 기리며, 매년 8월 14일을 세계 일본군‘위안부’ 기림일로 지정했다. 그로부터 어느덧 올해로 제10차 세계 일본군‘위안부’기림일을 맞이하게 되었다.

대한민국에서도 2017년 12월 ⎾일제하 일본군‘위안부’ 피해자에 대한 보호 지원 및 기념사업 등에 관한 법률⏌을 개정하여, 8월 14일을 <일본군‘위안부’피해자 기림의 날>로 지정하고, 2018년 8월 14일부터 공식 국가기념일로 지켜왔다.

그러나 여전히 일본군‘위안부’피해자들에게 정의 실현은 지연되고 있다. 일본의 역사교과서에서 ‘위안부’ 문제는 사라졌으며, 일본정부는 한국정부에게 피해자들이 거부한 ‘위안부’관련 2015 한일합의를 지키라고 종용하며, 한일관계 개선을 바라는 한국정부에게 오히려 해결책을 내오라는, 가해자와 피해자의 위치가 전도된 발언을 일삼고 있다.

우리 국민들은 잊지 않고 있다. 2015 한일합의 후, 아베 일본 전 총리는 “내 입으로 사죄할 생각이 털끝만큼도 없다”, “앞으로 위안부 문제에 대해 이야기하지 않는다”, “위안부를 성노예라고 부르는 것은 일본에 대한 비방중상이다”, “여성들을 강제로 연행했다는 증거는 없다”, “2015 한일합의로 위안부 문제는 최종적이고 불가역적으로 종결되었다” 등 피해자들에게 상처를 주고, 한일관계에 걸림돌이 되는 발언을 서슴지 않았다. 이것이 바로 2015 한일합의의 본질이다.

8월 14일 일본군‘위안부’ 피해자 기림의 날을 맞이하는 대한민국 국회의원인 우리는 일본군 ‘위안부’ 피해자들의 침묵을 깬 용기와 인권․평화운동가로서의 삶을 기린다. 나아가 현재 한․일간에 이루어지고 있는 논의가 2015 한일합의로의 회귀나 복원이 아니라, 국제인권 원칙과 규범에 따라 피해자들의 인권과 명예가 회복되는 모색이기를 바란다. 이를 위해 입법조치를 포함한 모든 노력을 다할 것이다. 이것이 한․일간의 진정한 미래지향적인 관계를 만들어내는 길이며, 한․일 및 세계 미래세대들에게 평화로운 세상을 물려줄 수 있는 길임을 우리는 확신한다.

우리는 한․일 양국 정부와 국제사회에 다음과 같이 요구한다.

1. 일본정부는 피해자들과 유엔 등의 국제사회 요구대로 일본군‘위안부’문제의 진실, 정의, 배상, 재발방지를 위한 조치를 이행해야 한다.

2015 ‘위안부’ 한일합의는 2018년과 2019년에 한국정부가 밝혔듯이 일본군‘위안부’문제의 해결책이 될 수 없다. 일본정부의 출연금 10억 엔으로 설립된 화해치유재단도 법적으로 해산되었고, 이미 그 효력을 상실했다.

일본군‘위안부’문제는 일본군에 의해 조직적으로 자행된 성노예 범죄였으며, 인도에 반하는 범죄였다는 것이 이미 구 일본군 문서와 연합군 문서를 통해 드러났다. 또한 유엔 여성폭력문제특별보고관 등의 국제기구 보고서를 통해 확인되었다. 일본정부는 이러한 사실을 인정하고, 피해자들의 요구대로 공식 사죄와 법적 배상, 책임자 처벌과 역사교과서 기록, 추모비와 사료관 건립 등의 책임을 져야 한다.

2. 한국정부는 피해자중심주의를 위배하고 국제인권기준도 무시한 2015 한일합의는 이미 ‘위안부’ 문제의 해결책이 될 수 없다고 발표했던 정부의 공식 입장을 재확인하고, 피해자와 국민에게 약속한 대로 국제 인권규범에 입각하여 일본군‘위안부’ 문제의 정의로운 해결을 위해 노력해야 한다.

2018년 1월 9일, 한국 외교부는 2015 한일합의 후속조치를 발표하면서 “2015년 합의는 ‘위안부’ 문제의 진정한 해결이 될 수 없다”고 선언했고, “‘위안부’ 피해자분들의 명예, 존엄 회복 및 마음의 상처치유를 위해 우리 정부가 해야 할 모든 노력을 다해 나가겠다”고 밝혔다. 또한 2019년 12월 27일 헌법재판소는 2015 한일합의는 법적 구속력이 있는 조약에 해당되지 않으며, 일본군 ‘위안부’ 피해자의 피해 회복을 위한 법적 조치가 아님을 명확하게 밝혔다.

따라서 광복 77주년 및 일본군‘위안부’ 피해자 기림의 날을 맞이하며 한국정부가 해야 할 일은 2015 한일합의로의 복원이 아니라 피해자중심주의에 입각한 일본군‘위안부’문제의 정의로운 해결이다.

3. 세계 각국 의회와 정부는 그동안 국제사회가 권고한 대로 일본군‘위안부’ 문제의 진실, 정의, 배상, 재발방지 조치를 일본정부가 성실히 이행하도록 촉구해야 한다.

지난 30여 년 동안 국제사회는 일본군‘위안부’ 문제 해결을 위해 각고의 노력을 해 왔다. 그러한 노력으로 인해 유엔을 비롯한 국제인권기구와 미국, 유럽연합 등 세계 의회는 일본군‘위안부’ 문제를 성노예제로 인정하고, 일본정부에게 피해자들의 인권과 명예회복을 위한 법적 조치를 다할 것을 권고했다. 이제 남은 것은 국제사회의 권고대로 일본정부가 반인도적인 범죄이며 성노예 범죄로 규정된 일본군‘위안부’ 문제에 대해 사죄와 배상, 진실규명과 교육, 추모비 건립 등의 의무를 다하여 국제인권규범이 실현되도록 노력하는 것이다. 이것이 실현되도록 국제사회가 나서줄 것을 요청한다. 이로써 여전히 계속되고 있는 세계 전시 성폭력 범죄의 근절과 재발방지를 위한 국제사회의 인권규범을 계승해 나가는 길을 열 수 있을 것이다.

日本軍「慰安婦」被害者をたたえる日を迎えて

日本軍「慰安婦」問題の正しい解決を要求する。

2022年8月14日は韓国が日帝の植民地支配解放から77年の節目を迎える日の前日にあたり、金学順さんが記者会見を開いて日本軍「慰安婦」被害者であることを初めて公の場で証言した日から31年となる日でもある。

1991年8月14日、金学順さんは解放後半世紀に渡って強いられてきた沈黙を破り、ご自身が日本軍「慰安婦」被害者であることを公の場で明らかにした。その勇気ある行動はさらなる勇気を呼び、韓国全域、さらには北朝鮮、日本、フィリピン、台湾、中国、インドネシア、オランダ、オーストラリア等世界各地の被害者も立ち上がるようになって、全世界の被害者と市民が共に連帯しながら日本軍「慰安婦」問題の解決及び戦時性暴力問題の解決に努めてきた。

2012年に台湾で開催された第11回日本軍「慰安婦」問題解決のためのアジア連帯会議の参加者らは、初めて沈黙を破った金学順さんの勇気をたたえ、毎年8月14日を世界日本軍「慰安婦」被害者をたたえる日に定めた。その世界日本軍「慰安婦」被害者をたたえる日は今年で早10年目を迎える。

大韓民国でも2017年12月に「日帝下日本軍慰安婦被害者に対する保護・支援及び記念事業等に関する法律」を改正し、毎年8月14日を日本軍「慰安婦」被害者をたたえる日に定め、2018年8月14日から国の公式記念日としてきた。

しかし、日本軍「慰安婦」被害者の求める正義は未だ実現されずにいる。日本の歴史教科書から「慰安婦」問題の記述は削除され、日本政府は韓国政府に対して被害者が受け入れを拒んでいる「慰安婦」問題をめぐる2015年の韓日合意の履行を督促し、また、韓日関係の改善を望んでいる韓国政府に解決策の捻出を求める等、被害者と加害者の立場が逆転したような発言を繰り返している。

韓国国民は忘れていない。2015年の韓日合意後、日本の安倍元総理は「自分の口で謝罪する考えは毛頭ない」、「今後は慰安婦問題について話さない」、「慰安婦を性奴隷と呼ぶのは日本に対する誹謗中傷だ」、「女性らを強制連行したという証拠はない」、「2015年の日韓合意で慰安婦問題は最終的かつ不可逆的に解決した」等、被害者を傷付け、韓日関係を妨げる発言をすることをためらわなかった。それこそが2015年の韓日合意の本質である。

8月14日の日本軍「慰安婦」被害者をたたえる日を迎える大韓民国の国会議員である我々は、日本軍「慰安婦」被害者の沈黙を破った勇気と人権・平和運動家としての生涯をたたえる。そして、現在韓日間で行われている議論が2015年の韓日合意への回帰や復元ではなく、国際人権原則と規範に則って被害者の人権と名誉を回復させる内容のものになることを望む。我々は立法措置を含むすべての努力を行う考えだ。それこそが韓日間の真なる未来志向の関係を構築する道であり、韓日と世界の次の世代に平和な世界を譲り渡す道であると、我々は確信している。

我々は韓日両国政府と国際社会に対し、以下の通りに要求する。

1.日本政府は被害者及び国連等の国際社会の要求通りに日本軍「慰安婦」問題の真実究明、正義の実現、賠償、再発防止措置を履行しなければならない。

2015年の「慰安婦」韓日合意は、2018年と2019年に韓国政府がはっきりと示した通り、日本軍「慰安婦」問題の解決策になり得ない。日本政府が拠出した10億円で設立された和解・癒やし財団も法的に解散され、既にその効力が失われている。

日本軍「慰安婦」問題は日本軍によって組織的に行われた性奴隷犯罪かつ人道に反する犯罪であったということが既に旧日本軍文書と連合軍文書で明らかになっており、女性に対する暴力に関する国連特別報告者等の国際機関の報告書からも確認されている。日本政府はこのような事実を認め、被害者の要求通りに公式謝罪と法的賠償、責任者の処罰と歴史教科書への掲載、追悼碑と史料館の建設等の責任を負わねばならない。

2.韓国政府は、被害者中心主義に違背し国際人権基準を無視している2015年の韓日合意は「慰安婦」問題の解決策になり得ないと発表した政府の公式的な立場を再確認し、被害者と国民に約束した通り、国際人権規範に則って日本軍「慰安婦」問題の正しい解決に努めなければならない。

2018年1月9日に韓国外交部は2015年の韓日合意の後続措置を発表して「2015年の合意は「慰安婦」問題の真なる解決になり得ない」と宣言し、「「慰安婦」被害者の名誉・尊厳回復及び心の傷のケアのために韓国政府がすべき努力をすべて行う」と述べた。また、2019年12月27日には憲法裁判所が、2015年の韓日合意は法的拘束力を持つ条約ではなく、日本軍「慰安婦」被害者の被害回復のための法的措置でないことを明らかにした。

従って、光復77周年及び日本軍「慰安婦」被害者をたたえる日を迎え韓国政府が行うべきは、2015年の韓日合意への復元ではなく、被害者中心主義に基づいた日本軍「慰安婦」問題の正しい解決である。

3.世界各国の議会と政府は、これまで国際社会が勧告してきた日本軍「慰安婦」問題の真実究明、正義の実現、賠償、再発防止措置を日本政府が誠実に履行するよう促さなければならない。

この30余年間、国際社会は日本軍「慰安婦」問題の解決のために多大な努力を尽くしてきた。その甲斐あって国連をはじめとする国際人権機構やアメリカ、欧州連合等は日本軍「慰安婦」を性奴隷制と認め、日本政府に対し被害者の人権と名誉の回復に向けた法的措置を果たすことを勧告した。残るは日本政府が国際社会の勧告通りに、反人道的な犯罪かつ性奴隷犯罪に規定された日本軍「慰安婦」問題に関して謝罪と賠償、真実究明と周知教育、追悼碑設置等の義務を果たすことで、国際人権規範が実現するよう努めることだ。これには国際社会も声を上げることを要請する。そうすることで未だ世界各地で続いている戦時性暴力犯罪の根絶と再発防止に向けた国際社会の人権規範を継承する道を切り開いていくことができるはずである。

<Statement by the Members of the National Assembly of the Republic of Korea in Celebration of Comfort Women Victims’ Day>

We Demand the Just Resolution of the Japanese Military Sexual Slavery Issue in Celebration of Comfort Women Victims’ Day.

This year marks the 31st anniversary of Ms. Kim Hak-sun’s courageous act as the first woman in Korea to publicly testify about her experience as a comfort woman for the Japanese military in a press conference on August 14, 1991. On the following day this year, we will also be commemorating the 77th anniversary of Korea’s liberation from Japanese colonialism.

After more than five decades of forced silence, on August 14, 1991, Ms. Kim testified publicly that she was one of the victims coerced into sexual slavery by the Japanese military. Her testimony inspired other victims in North and South Korea, Japan, the Philippines, Taiwan, China, Indonesia, the Netherlands, and Australia to come forward. It also brought victims and citizens from around the world together to work for the resolution of the Japanese military sexual slavery issue and wartime sexual violence.

The attendees of the 11th Asian Solidarity Conference held in Taiwan in 2012 for the resolution of the Japanese military sexual slavery issue honored Ms. Kim’s courage to break the silence for the first time and declared August 14 International Memorial Day for Comfort Women. This year celebrates its 10th iteration.

Korea amended the Act on Protection, Support and Commemorative Projects for Sexual Slavery Victims of the Japanese Imperial Army in December 2017 to designate August 14 as Comfort Women Victims’ Day and has commemorated it as a national memorial day since 2018.

However, the realization of justice still seems far away for the victims of Japanese military sexual slavery. The comfort women issue has been erased from Japan’s history textbooks. Japan, the perpetrator, is urging Korea to comply with the 2015 Korea-Japan comfort women agreement that the victims refused to acknowledge and come up with solutions for the dispute.

Japan’s many brazen acts are engraved in the memory of the Korean people. Following the 2015 agreement, former Japanese Prime Minister Abe Shinzo made a series of remarks that were insulting to the victims and aggravated the conflict between the two countries, including “I have absolutely no intention to apologize,” “We shall not mention the comfort women issue in the future,” “It is defamation of Japan to say that comfort women were sexual slaves,” “There is no evidence that these women were forcefully mobilized,” and “The comfort women issue was finally and irreversibly resolved with the 2015 agreement.” His remarks well convey the nature of the 2015 agreement.

In celebration of Comfort Women Victims’ Day on August 14, we, the National Assembly Members of the Republic of Korea, hereby praise the victims’ courage to break the silence about their wounds and honor their lives as human rights and peace activists. In addition, we sincerely hope that ongoing discussions between Korea and Japan are aimed at truly restoring the human rights and honor of the victims pursuant to international principles and norms, instead of returning to the 2015 agreement. To this end, we will take every possible measure, including the enactment of necessary laws. We are certain that this is the path toward shaping forward-looking bilateral relations and building a peaceful world for future generations.

We demand that the governments of Korea and Japan and the international community do as follows.

1. The Japanese government must implement measures to uncover the truth of the comfort women issue, provide compensation, and prevent recurrence as demanded by the victims and international community including the UN.

As the Korean government made it clear in 2018 and 2019, the 2015 agreement cannot be the solution for the comfort women issue. The Reconciliation and Healing Foundation, which was established with the Japanese Government’s funding of JPY 1 billion, has been legally dissolved and long lost its effectiveness.

It was already revealed through official documents of the Japanese military and Allied Forces that the comfort women were victims of the sexual slavery system operated by the Japanese Imperial Army, which is a crime against humanity recognized in the report by the UN’s Special Rapporteur on Violence against Women, etc. The Japanese government must accept its responsibility and meet the victims’ demands to make an official apology, provide compensation, punish those involved in the crime, record the issue in its history textbooks, and construct a monument and museum for the victims.

2. The Korean government must reaffirm its official stance that the 2015 agreement, which is against the victim-centered approach and international human rights standards, cannot be the solution for the comfort women issue and strive to realize a just resolution pursuant to international norms as it promised the victims and the public.

In its announcement of the follow-up measures for the 2015 agreement on January 9, 2018, the Korean Ministry of Foreign Affairs stated that the agreement cannot be the solution for the issue and that the government would strive to restore the honor of the victims and heal their wounds. On December 27, 2019, the Constitutional Court clarified that the agreement is neither a legally binding treaty nor a legal measure to repair the damage to the victims. The Korean government at this moment faces the task of advancing the just resolution of the comfort women issue through a victim-centered approach, instead of returning to the 2015 agreement.

3. Parliaments and governments around the world must urge Japan to faithfully implement measures to uncover the truth of the comfort women issue, provide necessary compensation, and prevent recurrence as recommended by the international community.

Over the past three decades, the international community has made a concerted effort to resolve the comfort women issue. International human rights organizations including the UN and parliaments of the US and EU have officially recognized the comfort women as victims of Japanese military sexual slavery and recommended that the Japanese government take legal measures to restore the human rights and honor of the victims. It is high time for the Japanese government to apologize and provide compensation for this crime against humanity as recommended by the international community. It should also fulfill its duty to uncover the truth of this crime, include it in the nation’s history education, and construct a commemorative monument to remain faithful to international human rights norms. We request the international community’s action to realize this. We believe this is the way to eliminate wartime sexual violence, which is still ongoing, and prevent the recurrence of similar crimes.
